Terms of Service

Welcome to ThohuCRM, a Software-as-a-Service (SaaS) Customer Relationship Management platform developed and operated by Isleen Solutions Private Limited (“ThohuCRM”, “we”, “our”, or “us”).

These Terms of Service (“Terms”) govern your access to and use of the ThohuCRM website, applications, APIs, integrations, and related services (collectively, the “Services”).

By creating an account, accessing, or using the Services, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old and capable of entering into legally binding agreements to use the Services.

If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Our Services

ThohuCRM provides cloud-based customer relationship management software, including but not limited to:

  • Lead Management
  • Contact Management
  • Sales Pipeline Management
  • Task and Activity Management
  • Marketing Integrations
  • WhatsApp Integrations
  • Meta (Facebook) Lead Ads Integration
  • APIs and Webhooks
  • Reporting and Analytics
  • Custom Modules and Extensions

Features may change over time as the platform evolves.

3. Account Registration

You agree to:

  • Provide accurate and complete registration information.
  • Keep your account credentials secure.
  • Notify us immediately of any unauthorized access.
  • Be responsible for all activities performed under your account.

You are responsible for maintaining the confidentiality of your passwords and API credentials.

4. Customer Data

You retain ownership of all business data stored in your ThohuCRM account.

By using the Services, you grant ThohuCRM a limited right to process, store, transmit, and back up your data solely for the purpose of providing the Services.

We do not claim ownership of your customer data.

5. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose.
  • Upload malicious software or harmful code.
  • Attempt unauthorized access to any system or account.
  • Interfere with the operation or security of the Services.
  • Use the Services to violate applicable laws or third-party rights.
  • Circumvent usage limits, licensing, or security controls.

We reserve the right to suspend or terminate accounts engaged in prohibited activities.

6. Third-Party Integrations

ThohuCRM may integrate with third-party services including:

  • Meta (Facebook)
  • WhatsApp Business Platform
  • Google Workspace
  • Microsoft 365
  • Payment providers
  • Email providers
  • Telephony providers
  • Other supported applications

Your use of third-party services is governed by their respective terms and privacy policies.

ThohuCRM is not responsible for changes, outages, or actions of third-party services.

7. Meta (Facebook) Integration

If you connect your Meta account to ThohuCRM:

  • You authorize ThohuCRM to access the permissions you explicitly grant.
  • ThohuCRM will use this access only to provide the requested functionality.
  • You may disconnect the integration at any time.
  • You remain responsible for complying with Meta’s Platform Terms and applicable laws.

8. APIs and Developer Access

If you use the ThohuCRM API:

  • You must protect your API credentials.
  • You must not abuse rate limits or attempt to compromise the platform.
  • API access may be modified or suspended if it affects platform stability or security.

9. Subscription and Billing

Access to certain features requires a paid subscription.

Subscription fees, billing cycles, taxes, and renewal terms are presented at the time of purchase or in your service agreement.

Unless otherwise agreed in writing:

  • Subscription fees are payable in advance.
  • Applicable taxes, including GST where required, are additional.
  • Failure to pay may result in suspension or termination of Services.

10. Availability

We strive to provide reliable Services but do not guarantee uninterrupted or error-free operation.

Scheduled maintenance, upgrades, or circumstances beyond our control may temporarily affect service availability.

11. Intellectual Property

All rights, title, and interest in the ThohuCRM platform, including software, designs, documentation, trademarks, and content, remain the exclusive property of Isleen Solutions Private Limited or its licensors.

These Terms do not transfer any intellectual property rights to you.

12. Confidentiality

Both parties agree to protect confidential information received from the other party and to use such information only for purposes related to the Services.

This obligation survives termination of the agreement.

13. Data Security

We implement commercially reasonable administrative, technical, and organizational measures to protect customer information.

However, no method of electronic storage or internet transmission is completely secure, and we cannot guarantee absolute security.

14. Suspension and Termination

We may suspend or terminate access to the Services if:

  • You violate these Terms.
  • Your account poses a security risk.
  • Required payments remain outstanding.
  • We are required to do so by law.

You may discontinue using the Services at any time.

Termination does not relieve you of any outstanding payment obligations.

15. Disclaimer of Warranties

The Services are provided on an “AS IS” and “AS AVAILABLE” basis.

To the maximum extent permitted by law, ThohuCRM disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

16. Limitation of Liability

To the fullest extent permitted by applicable law:

  • ThohuCRM shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including loss of profits, revenue, business opportunities, goodwill, or data.
  • Our total aggregate liability arising out of or relating to the Services shall not exceed the amount paid by you for the Services during the twelve (12) months preceding the event giving rise to the claim.

Some jurisdictions may not permit certain limitations, in which case those limitations will apply only to the extent permitted by law.

17. Indemnification

You agree to indemnify and hold harmless Isleen Solutions Private Limited, its directors, employees, affiliates, and partners from claims, damages, liabilities, costs, and expenses arising from:

  • Your use of the Services.
  • Your violation of these Terms.
  • Your violation of applicable laws.
  • Your infringement of third-party rights.

18. Governing Law

These Terms are governed by and construed in accordance with the laws of India.

Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Bengaluru, Karnataka, India.

19. Changes to These Terms

We may update these Terms from time to time.

The revised version will be posted on this page with an updated effective date.

Continued use of the Services after the revised Terms become effective constitutes acceptance of the updated Terms.
